The rule for most jurisdictions is that the vehicle must default to a mode consistent with its published mpg ratings. Since sport mode can be configured to change engine rev thresholds, the sport settings can put you outside of the published mpg ratings. In that case, you would be well outside of the published mpg specifications. Thus, you can't default to sport mode.

This is probably one of the reasons BMW was reluctant to have ASS default to "off."

In fact, maybe BMW had counted on ASS to eek out its superb mileage ratings for the new 3 series---BMW was forced to reconsider its published specs in this area.
