245-40-20, is it OK?

I have set of wheels and tires from previous car.
offset and bolt pattern are good to go.
But, onlyproblem is tire size.
The difference btw 245-40-20 and 245-35-20 is 3.6%.
It's little over 3% upsizing rule.
Should be a problem?

3.5% variance is too much.

Speedo is one issue to be concened. The car's computer may also give warning due to the rotational differences. Lastly, a chance of car pulling to right or left.
