Sharing tears... This happened to mine a week ago. Still in the process, but the other guy's insurance company is taking care of everything. So far $11K in repairs...

The best thing is to contact the other insurance company FIRST and provide them with an estimate and also make a diminished value claim. Most states do not allow you to go after your own insurance company for diminished value.
If they try to screw you in some way and not pay everything, then go ahead and contact YOUR insurance company. They will likely pay minus deductible. They'll Subrogate against the other insurance companies, and once they get their money back, they will refund your deductible. At least in FL that's not technically a claim since you're not at fault, so it should not count against you. Your mileage may vary obviously. The easy way is to get your insurance to pay everything and sit back. Good luck. Damage doesn't look too bad, so you should be glad you were the lead car and not the filling in the sandwich. |

Get everything agreed upon upfront. I would not wait until everything is done.
Remember that repairs have little to do with diminished value. Diminished value for me is the difference in price between my fully repaired car (that now pops into Carfax), and my car with a clean record. I don't think most people will argue with the fact that you'll be willing to pay less for a car that's been involved in an accident v. one that hasn't. How much that's worth is entirely up to you. Depends on the condition of your car, age, mileage, prior accidents, and to some extent your willingness to pursue the claim. I've made diminished value claims in the past and it's been anywhere between $500 to $15,000 for an exotic vehicle. Like I said before, my recommendation is to get everything agreed upon before starting any repairs. The other thing to remember is that insurance companies will generally try to screw you any way they can. Another popular way is on the rental. Typically they try to say THEIR insured only has $X per day for rental coverage, so they'll only pay that. This is simply not applicable to you. You never agreed to those terms, not to mention that it's a different policy provision altogether that goes into effect and not the rental provision. I would at the very least ask for a full size vehicle. Try for a luxury rental, although that may be pushing it... If you ultimately decide to go though your insurance policy, then the rental terms of your policy would come into play. Remember everything gets agreed upon upfront. |

I asked them what the rental was and they told me a sub-compact. I laughed at the guy and told him not to bother picking me up as I needed to figure out what the insurance company had authorized. I was approved for a full-size premium vehicle, so in this case they seemed to be reasonable. As far as agreeing to everything up-front, I will certainly get that finalized before accepting the repairs. Interesting that you've gotten that agreed upon before repairs began. I'd expect the full repair costs wouldn't be known until they tear the vehicle apart... but at least now I know and will press the issue. Thanks for the insight. |
