Lemon F10: Is a good idea to buy one that was fixed by BMW?
I found this place in Texas that sells cars that have a "buy back/lemon" showing in their records. But they say the cars were already fixed by BMW and that is under full warranty. He added that California law on Lemons is very easy to abuse and most cars are not real Lemons. Are just returns.
Now this is car is much cheaper than any other place. Should I buy one? |

I've never heard of CA lemon law being easy to abuse. As I understand it, it takes like 3 - 4 major trips to the service department within a relativity short period of time. Something like 6 months. And you need all the paperwork backing it up. So that would be tow records and service history and then its still not automatic guarantee. I think it has to go to arbitration if there is a dispute that that takes time too. So... Yeah. I would be cautious.

Depends on what it was for. And how big the discount is.

I wouldn't touch it with a 10 foot pole. Regardless of what you think of CA or TX laws, the laws are in place to protect the consumer. In CA, for example, the car needs to be brought it at least 3 times for the same repair during a set period of time. BMW may have bought back the car to avoid the hassle and expense of litigation, but the fact remains there was a problem that was not addressed by the dealer/BMW reps.
In addition to this, you will always have a car with a branded title, which will make it all the more difficult for you to sell it when you are ready to do so. Chances are you'll have to do it on your own, or to a dealership like the one selling the car and you will take a hit on what you will get in return. My .02: proceed with caution. |

Just last week, many BMW dealers here in Chicago had new (i.e. never titled) 2011 535i xDrive demo cars reduced $11K. The car you mentioned w/8K miles (but not an M-Sport) as a dealer demo was listed as $48K. And they had several of them. Avoid lemons at all costs (some of us even avoid the demo cars.)

Some of the brand new ones has enough issues as it is and this is off of a lemon record?? Forget it. But if you can get that 2011 f10 down to $10000 OTD. Sure go for it haha

We purchased three cars from them. An 2010 E60 535i M-Sport ( that is currently in the garage ), X6 50i & 2009 335i E92 with no regrets. Why did we buy these cars? Well first of all, we got the official document that stated what was replaced and what caused the cars to be labeled as a Lemon.
Back when we bought the cars though, the prices weren't as inflated, and actually seemed reasonable, after following Joe "The owner of SCM, or once was" for quite a while, we noticed cars were increasing in price. Why? Less & Less cars at auctions for Manufacturer buyback. A few of those cars were lemoned at less than 1,200 miles, great condition practically like new. Now why? EG: Owner gets a car, signs a 2 year lease, ends up not liking the car so he attempts to nitpick at something to get BMW to buy it back. It really depends if car is in good shape or not, miles, and the price. All factory warentee remains, and we actually got some excellent service at a local dealer of ours even though the wasn't purchased through them. As always, think three times before you make a commitment, and if you have a costco membership buy the cars through their auto program, ends up being extremely competitive with Joe's pricing, but you get a brand new car. At these prices, I would not even bother. You can easily get a dealer loaner or a slightly used one at these prices, if not better. And the new cars have better deals so you can get a brand new one for a little bit more.

BMW isn't exactly known for its aftersales service ... at least for the dealers in the NY/NJ region as well as BMWNA itself. I'd imagine if you run into any trouble with the lemon, its probably lots of frustration to get things sorted out.
