Cop told me he could write me a ticket for M Performance exhaust.

So a cop moved into my neighborhood. His house is near the entrance/exit to the development, so I drive by his house going to and fro.

I met him at a neighborhood poker game this past weekend. We started talking and he asked about my car, and what exactly I did to the exhaust system. I said I put the optional BMW performance exhaust on it. He response was that he could give me a ticket for that, and that I should change it back to stock. WTF?

I said I didn't understand how I could get ticketed for it, since it is a genuine BMW product, and thus 50 state legal/CARB certified. He said that tickets can be given to any car that has any change whatsoever to the exhaust system.

At that point, I excused myself and didn't have any contact with him for the rest of the night.

I think he's wrong, and he def came across as a guy who thinks he knows everything, even though he doesn't. Maybe he doesn't like the sound my car makes when it drives by his house everyday?

Tell him to fuck off. Back when I had a Mustang there was a moved into my neighborhood in my neighborhood. A week or so after I got the car, he tailed me and light up his lights as I was heading to school. He claimed I didn't have mufflers on my car, (which I did).

Apparently my Borla S-Type was too loud for his taste. Although he had nothing he could do about it. In reality, not that loud. Ended up dating his daughter, which he was not happy with though. Fuck that douche.


In reality, that cop has no legal claim to ticket you. Especially since you don't even have an aftermarket exahust!

Wow, what a douchebag. That guys not going to be very popular in the neighborhood with that kind of an attitude.

Tell him to stop running his mouth and write out the ticket if he has got a problem with it and you will soon find out if he is bluffing, which I'm sure he is.

I'm not an expert in US law, but surely BMW would not sell you something that will potentially get customers in trouble with the law...

As a California resident, here are the two vehicle code sections that apply to exhaust modifications:

27150(a): (a) Every motor vehicle subject to registration shall at all times be equipped with an adequate muffler in constant operation and properly maintained to prevent any excessive or unusual noise, and no muffler or exhaust system shall be equipped with a cutout, bypass, or similar device.
(b) Except as provided in Division 16.5 (commencing with Section 38000) with respect to off-highway motor vehicles subject to identification, every passenger vehicle operated off the highways shall at all times be equipped with an adequate muffler in constant operation and properly maintained so as to meet the requirements of Article 2.5 (commencing with Section 27200), and no muffler or exhaust system shall be equipped with a cutout, bypass, or similar device.
(c) The provisions of subdivision (b) shall not be applicable to passenger vehicles being operated off the highways in an organized racing or competitive event conducted under the auspices of a recognized sanctioning body or by permit issued by the local governmental authority having jurisdiction.

27151(a): No person shall modify the exhaust system of a motor vehicle in a manner which will amplify or increase the noise emitted by the motor of the vehicle so that the vehicle is not in compliance with the provisions of Section 27150 or exceeds the noise limits established for the type of vehicle in Article 2.5 (commencing with Section 27200). No person shall operate a motor vehicle with an exhaust system so modified.
(b) For the purposes of exhaust systems installed on motor vehicles with a manufacturer’s gross vehicle weight rating of less than 6,000 pounds, other than motorcycles, a sound level of 95 dbA or less, when tested in accordance with Society of Automotive Engineers Standard J1169 May 1998, complies with this section. Motor vehicle exhaust systems or parts thereof include, but are not limited to, nonoriginal exhaust equipment.

In short, unless he can prove at the time of citation that your exhaust was emitting a sound level greater than 95 dbA, you should be fine.

My guess is that you're correct in assuming the sound of your exhaust has ruffled his feathers, and in return, he's unfortunately trying to do the same...

He writes the ticket. You go to court to fight it. His ticket gets dismissed because your mufflers are legal.
(I'm sure because some full catbacks don't even hit 95db when pushed hard.)

Who goes to a poker game and starts trying to intimidate a neighbor?

point blank its a factory item, A cop did this to a buddy with a sti. It was a full stock exhaust and the cop claimed it was aftermarket unit. He took the ticket to his Subaru dealer, they looked at the exhaust and wrote up a statement with detail of the exhaust being a factory part and the cop is absolute wrong on it being aftermarket 100% also took pictures of the stampings of the exhaust!

long story short the cop looked so stupid when we went to the court!
