I was in a similar situation with you when we first got our Infinity M45 in 2008. After 9 months of ownership, 38k damage (including frame damage) was incurred on a car valued close to 50k. Insurance decided to fix it (to my surprise).

At that time, I was told the best way to handle it was to find out if your state has laws regarding diminished value of cars. Your adjuster may or may not include it, but if they don't, you may be able to take them to court to get that DV added to the cost of the car. It may very well put it over their threshold of fixing or totaling the car. Also, as someone had previously suggested, get quotes from multiple approved repair facilities as well. Luckily, the most respected repair shop in my town was also an approved vendor so I know the quote I got was legit.

Since the car was leased, I decided not to spend too much time fighting it (but I was ready if needed). I told Infinity financial (since they really own the car) that the car was in a serious wreck and it would repaired instead of replaced...thinking that they would further pursue action with the insurance as I thought a car that previously had frame damage would suffer a severe loss of value. They agreed with the adjuster so we left it at that but not before I confirmed I would not be penalized at end of lease for this wreck.

Push to get it totaled. This was 19k worth of damage. They rigged the main wore harness on that side because it got ripped up in the wreck and they didn't want to wait 8 weeks to get a new one from
Germany. I traded it In and ordered a new one after it was repaired.

Got the call from the adjuster today... he said my car had substantial damage and all the sensors and computers had gone haywire. I guess the computer was so messued up that nothing would turn on. He said his computer calculated $47K to repair the car...so it will be a total loss. Supposed to get a call from the total loss dept about the value and pay off for my car..hoping the value comes in a little high so I can get a little cash to pay off my deductible and down payment for the new car..

Never thought I would say congratulation to soemone who just had their car totaled, but this is the best case senerio for you, I am glad I was wrong. So whats next? a LCI 550i?

Haha i wish. I had such an amazing deal on this ride I don't think I can get a deal like that on this again. 550 is way out of my budget. I think ima buy a mustang GT this will be my first non BMW in like 6 years
