Had a DME failure

My car has been at BMW for a week after my DME has failed... they refused to warranty it because i have down pipes.... while dealer clearly told me he has no issues with bolt ons. I asked back for my DME and think i will be able to fix the issue since i was able to find a thread with similar failure. I will try to escalate this with BMW N/A.

did they give you a cause of failure? Or just the typical "we don't know what broke, but you have aftermarket mods so were just voiding everything" ?

Ehh I worked at dealers for a long time before I switched to LE, a lot depends on the tech. Most techs get very little diag time for warranty work (sometimes 2/10ths of an hour is all they get paid for a diag that takes an hour) with the hopes they might get their balls chopped off with some warranty time thats also significantly less than retail time. If its an issue they can't figure out quickly and have a nice scapegoat like downpipes, they just figure they will pass the buck on to you and pull the warranty void card. Saves having to spend 2 hours diagnosing a problem to find out it isn't warranty and then get nothing from warranty (warranty only pays if its warranty) or try to charge your for the dig which sometimes works, but other times just causes a huge fight. The other option is you pay them the two hour diag and might get lucky if it is warranty, hoping the tech is trustworthy enough to say its not caused by the downpipes and lose his customer pay diag to get stuck with warranty time.

Slippery slope and they bank on the customer sucking it up and leaving as opposed to going after them with BMW or an attorney. I generally fight with the manufacturer to at least get a diag covered to find out what the TRUE CAUSE of failure is, and if its downpipes, you suck it up and apologize, if its not, you tell them you want it fixed, a loaner, and a free detail for your time you wasted chasing them around in circles. While legally they can't void your warranty unless the aftermarket part caused the damage, its a long and expensive road to go down unless you have a $10,000 engine at stake.

That BLOWS! BUT being the dealer they can makeup whatever they want to say and bring up the warranty card threat

Out of curiosity, is this a common failure? And coming from the Domestic world, is the DME the same as the ECU ?

That's sucks. I'm wondering if clearing codes frequently could cause an issue. Maybe not actually a hardware issue but something in the software that says if the code it tripped too many times the DME shuts down. We need to come up with a solution for codes with downpipes.

I picked up one of these.

I think it will work with Dash Command on my iPad. Maybe I can take some O2 sensor reading on my car with stock pipes. Then find someone with DP's to do the same. A piggyback to offset the O2 sensor reading might be possible.

I did a little research on Rock Auto's website and it looks like the N63 has (4) O2 sensors. One on each bank before and after the Cats. Does that sound correct?

Wouldn't have anything to do with their recent care package flash? If they can't prove you had tuning they can't prove "modding" caused the issue. You should be able to fight this. Good luck sir.
