Will this exhaust cause CA smog test to fail?

I have a 2011 535i M sport and was thinking of installing this exhaust.

Does anyone know if it will cause a smog test to fail in California?

Maybe the noise level deems that exhaust system as an "off road application". It would probably drive you nuts with drone on an every day basis.

Besides, CA doesn't require you to smog test a car until it is 7 years old.

So who cares?
