Brand New 2010 BMW 535i?

I was checking the BMW dealerships in California and noticed a brand new 535i sedan with the color combo I was looking for. I found it in their "brand new inventory" with an almost $9,000 discount off MSRP. I offered the internet CA a cash price for the car. He said that before he went to his manager with the offer, that he had to tell me something about the car. Here is his email to me:

"Thank you for your reply. Before I take your offer to the General Sales
Manager, I am not sure if you are aware that this 2010 535 has 1269 miles as
of now (i just verified this). This car is still new with the full 4 year
or 50K warranty not started yet. The reason is this car was once sold,
but buyers were not approved, so we when we got the car back it had 1200
miles."

After I received this info, I withdrew my offer My question is, should the dealership advertise this car as being "brand new," when it clearly is not? How much discount should they offer on a "used car?" They're already offering $9,000 off. I want the car, but not at a new car price. I appreciate any suggestions you have to offer.

Doesn't matter if it is called a new car or a used car. The fact is that it's been driven for 1200 miles. Dealers routinely sell demo cars as new but with some discounts.

So negotiate like it is a used car. But I don't think it'll matter much.

Hypothetically speaking, if you were going to buy this car, how much would you be willing to pay? It's listed at $58,475-8450 discount=sale price of $49,995. Knowing what I know now about it, do you think $49,000 (out the door) is a fair price?

So that's another 10% off the sale price since tax is around 9.5% + license fee, etc.

The key now is to confirm the dealer's story, and check out the car's real history. Then, it is up to you whether or not you think it is a good deal.

For me, if the car checks out good I would think it is a decent deal. You are getting ~$13k off the retail price for a slighted used 2010 "new" car.

Thats roughly 14.5%. If you really want it, I would offer them $45,000, about 20% discount, and see what happens. What is it worth to you. It is very low millage and will have full warranty. It is just that it is a previous model and if that does not bother you go for the lower bid and see if they accept it. Stay firm as it appears it is not selling. Good luck!

Well, out the door $49,000 is like $45,000 in California. We have 9.5% tax.

Are you referring to $45,000 including tax? That would make the selling price $41,000, and it probably won't get you a used 2010 with 15k miles.

I was assuming listed price of $58,475 was pretax, so less 20% would be roughly $45,000 before taxes. So roughly $49,000 with taxes then. Missed the (out the door) in my first read.

I wouldn't worry about the 1200 miles, that's assuming of course that the folks that "bought it" thought that they would qualify and didn't beat the crap out of it. Which is most likely. I have two thoughts:

It's the previous series body style, and is worth nothing in resale. If it was worth 49K, they would have sold it by now.

You may have issues with the car having sat for so long. When was it built?

How much more would it cost you to buy an F10 equipped similarly - or more importantly - the way that you want it? Are you going to keep this car forever? If not, figure in the cost of depreciation as well. A 2010 535 is going to be worth a heck of a lot less than a 2011 535 simply because a) it's ugly and b) it's the previous generation body style and c) it has the N54 engine which has a bad rep for HPFP issues.

This car is a 2009, not a 2010. The reason is that the 2010 e60s came in with the new style wing mirrors that you see on the current 5. For reference in your picture, see the mirrors on the white 6 series by this car. This is what you will see on the 2010 models.

Here is the million dollar question for you... do you "hate" the F10 body style? you can EASILY get a 535 in the low 50's decently equipped. I wouldnt pay a dime over 35K for any previous gen 535 regardless of how many miles are on it.

First i wouldnt belive them that the guy didnt get approved, they know that in seconds, not after 1200 miles.
Second if you really want that car go down way more, i was at the dealer last night and they had an M6 MSRP 109k and 650i MSRP 90k, both cars were 20 k under the MSRP with out even negotiating a bit, it was the special, so just imagine how much you can get this 535i down by especially if its used and 2011 is siting right next to it at the dealership
