If you have documentation of problems, expenses related to the lawsuit, go to your local BMW dealer, you may be able to prove you had problems prior to that 131k. Our dealer in Murrieta (CA) has had our car since 11/9/18. The lawsuit includes a rental car, so I've been driving a long-term rental since then...no cost to me.
