I imagine if it's popping and banging or through an under pass they might do something but that hasn't happened either. Only the fine is going away though presumably you can just unplugged the mppsk so it doesn't open in sport when you get it tested. Or just have it tested in comfort.

It's in comfort by default, so there would be no reason to test it in Sport Plus. |

Revving past 4K in comfort mode will cause the valve to open so it will be louder. They may want to test the exhaust in sport mode also to see if it complies. |
May is a word used in law that means about nothing until there is reason otherwise.
They don't do this in inspection of exhaust. Nothing is more strict then California CARB testing.
