It's in comfort by default, so there would be no reason to test it in Sport Plus.
If the testing procedure involves revving past 4K then it will have to be unplugged to confirm it's fixed
Maybe go back and reread what I posted.

RPM's have nothing to do what I posted.
Revving past 4K in comfort mode will cause the valve to open so it will be louder. They may want to test the exhaust in sport mode also to see if it complies.
May is a word used in law that means about nothing until there is reason otherwise.

They don't do this in inspection of exhaust. Nothing is more strict then California CARB testing.
