The cheating generates extra horsepower from their PU by managing to significantly cool the air coming out of the car during acceleration.
If it isn't explicitly banned in the regulations, then it isn't cheating. Every team on the grid is doing this sort of thing as I type this, we just don't hear about it. It's textbook F1 engineering 101.

If they pass the FIA temperature tests, then they are compliant. It's the same as RedBull's 'bendy wings'.
