Now - that shouldn't have too much impact on a BMW buyback, but just keep in mind that you may not have the lemon law to fall back on if negotiations fall apart. And they may not know that, so keep it to yourself. They (BMW) would prefer a buyback because that doesn't show on the title and they'll have an easier time selling the car. I can't help but wonder if your car was already a buyback once already? Best of luck to you. Keep us posted.

My understanding is a buyback would clearly show in BMW service records. That is not the case, although it was in for 3 service visits within the first 5000 miles. If they don't offer a buyback, I assume they would need to continue trying to fix the car. I guess I'll just keep driving the loaner for the next 3.5 years if needed.

I don't see why. It's not a service, it's something between BMW N.A. and you. Or maybe the dealer will buy it back (that's happened to me once as well) in which case BMW N.A. wouldn't even know about it.

Buyback cars usually need to be labeled as such, depending on state.

My '11 535i had a minor vacuum leak at 10k (reduced power mode), it's now with 22k and still running strong (knock on wood).

My 2011 535i Prod date 7/2010 displayed the Engine Malfunction message two days ago. I took it to the dealer before turning off the engine. They looked at it yesterday and said they needed to reload the software this morning. I don't know if BMW has upgraded the software or not. In limp home mode I was able to slowly get it up to 90mph, with reduced acceleration. SA didn't have a clue.

Well I guess I will drive my Acura for another year as I was going to buy a new 5 series, but do not want to plop down $65K for a reliability headache.
I really love the design and features of the new BMW, but they have a long history of being a pain in the ass to own. |

I had another problem with the 11 535i. I had a cooler in the car that drew some power while stopped. This evidently degraded the charge in the battery somewhat. Five days later, I got a message that said that the battery was not charging. I used a battery charger that overnight got it back to normal, but two days later the same message came on, along with the engine malfunction message that it could not be restarted. I drove immediately to the dealer who kept it overnight, did a test and found that power had been taken from the battery for 30 minutes a week before. They reset the error code and charged me $50 for the privilege.
There is no way to reset the error code (that I know of), so, if you are in Montana with no dealers, the car will have to be flat bedded out of Montana, probably to Calgary, to get the error code reset. There is a lesson to be learned. Never have any device connected to the power while the car is not running. And never buy another BMW. I'll be picking up my Audi S5 in Ingolstadt in three weeks.
