My guess is that this was a car where a prior owner liked to stomp on it from a dead stop and at one point the transfer cases just exploded. Rather than get a new case, they just took the driveshaft off and coded it to be RWD. Depending on how long ago you bough it, what the ad said, and what kind of dealer you got it from (reputable or some crap place) I would go talk to them. But Court will cost you and there is no guarantee you will win. I would not go that far. Depending on what you paid and what the rest of the car is like, you could put in a used/rebuilt transfer case and used or off brand driveshaft. Or you could buy some beer and sell it with an honest listing about it's problem and move on with your life.

It's mainly my wife's car she really like it its a beautiful car nothing wrong with it other than the cv axle and the trans leak and well now this, my wife is an attorney so maybe we can talk to the dealer and see if we at least get them to pay for it

I'd say get money back and buy one with no issues.. Never guarantee that they will install it correctly and code it per spec.

You bought that car from a Dealer? wow!? I would definitely proceed with returning the car! Yeah I just noticed what Opie said and didnt notice the cracks until he spoke about it and then looked and then saw it!
