Dealership joy rides my friends M5

My friends purchased a used M5 1 month ago with 3,000 miles on it. He took delivery of it last week and he scheduled an oil change for Friday (only an oil change nothing else). After he dropped the car off his wife picked him up and they drove around in their SUV. About 1-2 hours passed by and he returned to the dealership pretty certain his car was ready to be picked up. On his way to the dealership he was stopped at an intersection and in front of him was his M5!!! The driver launched the car and proceeded to go down the road at what they believe was 100-110 on a 45 (they where driving 55 and could not even come anywhere close to the M5.) luckily he has a front/back dash camera in his SUV and they have it all recorded and saved. He doesn't know what to do because he never experienced this situation nor have I. So if you guys could provide some helpful information that would be great!!

Tell him to talk to the GM and/or service manager of the dealer.
I had a couple of idiots driving fresh off truck Mini Coopers fly by me on city street at about 80mph, weaving in and out of traffic. Called dealer and the SM was grateful, said he had a good idea who it wasn't their first time doing stupid stuff.
While the potential of getting someone fired sucks, if they don't respect other peoples stuff maybe it will be a leason.

Agree with this advice besides not respecting your friends car they are endangering other people doing that sort of speed around town

Just keep in mind that BMW guidelines say to change oil at operating temperature which one best achieves by driving. Not commenting on them breaking the law - your friend can go to the police or speak with the service boss.

I've had suspicions a dealer did that to my car too. I have an exhaust so I would think it's much more likely a tech were to be tempted to hot rod around a bit. Even my wheels feel a bit of vibration (very minimal) .... like they hit some pot holes or something.

I'd be furious, and I would insist on a full service and inspection by the shop foreman to determine if the car was abused beyond what was seen.

easy way to avoid that is take a pic of the odometer as they come to take the car in. that's what I do

While this does seem like some sense of reassurance, a lot of abuse can occur in 2-5 miles (the normal driving distance post-oil change)

Really??? Serious Cash???

I am pretty sure, in the back of the forms that everyone signs at the time of the drop off, dealerships perfectly cover their a-sses. Do you really think this is their 1st expereince with crap like this?

They will probably fire the a-hole who drove the car and OPs friend will end up with a $50 Gift Cert to dealer's gift store.

No paperwork in the world will protect you against one of your salesmen taking a customer car and using it as their personal track car of the day

Very true but as seen in here, it still happens.

There are plenty of cases out there..... I would just like to see an example of someone getting "serious cash" just bec a mechanic launched their car.

You do make a valid point about them able to fight it ... Obviously they have the money power to make it very costly for OP

That being said, this is not your local mechanic ... This is a BMW dealership.

1- Pretty sure they do not want bad rep
2- This can put their relationship with BMW at risk
3- If the managers were smart, they would rather give OP some kind of upgrade or cash back instead of getting involved in this

Of course this is my opinion and and i might be wrong

Alright after putting it onto a CD and getting ready to go to the dealership my friend was wondering if it would be a good idea for him to go with a lawyer? (Heres a little background on why) My friend feels like his car is ruined. It's hard to explain where he is getting at but anyone have any thoughts on how he should pursue this through a law suit.

I would be definitely be pissed, but at the same time, unless he was truly fucking up the car somehow I'm not sure there is anything to worry about. It's not as if an M5 isn't made to launch hard and climb to 100+...

If it's an auto, and the tires aren't fucked...not sure what a mechanic could really do to injure the car. Taking it for a fast spin is obvious, but abusing it would take some work.

What's he trying to recover?
What financial loss did he incur?
Does the vehicle have any issues or damage?

If the guy hit the throttle and it got stuck and he hit someone, should he sue the owner?

It's an M5. Performance car. Groupies are gonna flock.

Yeah it got driven hard without his permission. Focus on getting some guy fired for making a bad decision. If that floats his boat have at it.

Do not show up with an attorney. Big mistake! The instant you do that, they will have no choice but to clam up and bring in their own attorney, and I seriously doubt you can win that fight.

If you know what you want, go in and ask for it. If you don't know what you want, figure out before you get there. Then if you don't get the response you want discuss the matter with an attorney and explore your options.

That's my $0.02

Final thought...when I was service manager at a HD dealership I test drove many bikes that came through service. if they were fast, I drove them fast. You do have to test the customer experience, and who doesn't drive their M5 fast? Also a quick way to get the engine to temperature...within reason obviously.

Probably it's a non issue although I do completely get the irritation factor.

maybe because the car has only about 3K miles and was not broken in , driving that fast and launching it could cause some damage , thats what his friend is worried about... maybe im wrong.
