Lemonning it is a pita. better chance they just swap you into something else. I had an issue with an E60 they couldnt fix, put me in a new one. Had a problem with 328i they couldnt fix put me in a new one. and right now i have a problem with my F30 and they are about to put me in a new car, probably a 135.

Just make sure you have all the documentation. They get 3 tries to fix it or if it is in the shop over 30 days that qualifies too. ideally 3-4 times in the shop and around 4 weeks and if they still cant fix it then move forward. Has to be the same problem, cant be a bunch of different little things and make sure you have your dealer open a PUMA case on whatever it is they cant fix.

a little insight into what the issue is would be helpful.
Usually they do not want to lemon a car as it makes the car worthless and BMW looses money on it.
Keep putting pressure on them as they will most likley want to buy the car back and look into it more before it gets stamped as a lemon.
My dad picked up a new S6 a few years ago, and in the first week it kept overheating because of some failing sensor, so they quickly swapped it out so it wouldnt be a lemon

No charge, he gets reimbursed by the manufacturer.

Cool, how do you like the 135 compared to the 335 you had?
I had a 335 N54, loved it! Now i have a 328 F30, its nice but the steering vibration is a problem and am thinking of getting into a new 135.

I found out that I am more of a sedan type of guy. I too had a 2008 N54 335i sedan and loved it a lot. The 135 is an amazing car. It performs get. But it is a bit crammed for my taste. The reason why I got the 1 is because BMW took back my sedan 3 months early (which saved me some money as far as overage on miles) as long as I leased or bought another car. The 1 was the only car in my monthly price range at the time.

I'm lemoning the car becuase it's had brake issues for a while now and also needed a new tranny, which they replaced, along with other little knick knacks here and there.

It differs by state, I would reach out to a lemon lawyer. If your car truly is a lemon it should be no issue to get it replaced. Just make sure you have all the documentation to give to the lawyer.
I have had 2 N54 powered BMW's lemoned and it was rather a quite quick turn around. The last one was completed and surrendered in 3 weeks. But I had a large amount of issues with the car. Fuel pumps, water pump, turbo failure, consistant transmission issues that would keep popping up and DME replacements were the big ones so as you can see the car was a true definition of a lemon.
