Looks like it to me. When I had that issue I also had oil pooling in the depressions by the cap. Yours looks like a more serious leak and I would take care of that before the oil contaminates the serpentine belt.
Taking a closer look at the pictures, it looks like the belt already has oil on it and is contaminated. While you're there, I would change that also and do a through clean-up of all the oil. |

Extremely common leak from the oil filter housing and oil cooler housing gaskets. Upper radiator hose, belt and tensioner should also be replaced.
Potentially the thermostat hose as well "mickey mouse" but that isn't clearly seen in your pictures. It also usually gets wasted from the oil contamination. |

100% your failure to correct the issue in a timely manner just got a lot more expensive. The belt breaking is the normal failure that brings severely neglected leaking cars into the shop.
The correction now (beyond what I posted earlier) is pull the harmonic balancer and inspect/replace the crank seal. Drop the engine oil pan and remove belt material from the sump. Pick belt material out of the timing chain. Remove the oil pump pickup and flush belt debris from it. |

Thanks man. Got the parts at bmw today. Just need to take the harmonic balancer off and check the seal for leaks ... any one here taken one off ?

honestly if it shredded and you have the capability of pulling the pan I would. you dont want your oil pickup getting clogged or any material getting into places it shouldn't

I do have the capability of removing it the pan but what are the steps to it ? Do I have to replace the bolts to the pan ? but might as well do oil change also
