The photos he provided indicate possible frame damage, add to that the cost of replacing all the bags that blew, body panels, suspension components, paint, etc. and those costs quickly add up to a figure that outweighs the vehicle's current value.

This hurts to look at. Sorry man. I can feel your pain. Similar thing happened on the first ever (and still one of my favorite) cars I owned. 1991 Acura Integra...

Insurance adjuster came out this morning, its officially totaled. Still awaiting valuation and offer on the vehicle. I presented the adjuster with a slew of material regarding the accessories on the vehicle to take into consideration.
2 headlamps, 2 fenders, hood, front bumper, lip spoiler is $8k on its own. Front subframe, steering rack, 2 control arms, spindle, wheel hub and 2 wheels is another $8k. and that is only skin deep. Headlining, 4 airbags, all of the cooling system that is bent and broken, metric tons of plastic "stuff" behind the bumper, and who knows what else once torn down. |

Insurance finally came back to me with a number, they are offering $28k for the car without anything additional considered as of yet as *dun dun dun* it already exceeds the shitbirds minimum liability coverage policy limits of $25k.
Now I get to file with my own collision insurance (same company) and let them handle internal subrogation. |

Yeah I'm happy with the base valuation, less than thrilled that I now have to pursue getting paid through my own insurance.
Either insurance is going to pay a fair value for the add ons or they aren't getting them, I can strip and gut the car in a day on a lift at work and they can pick it up sitting on its rotors for all I care. The wheels should I be poised to retain the parts, or the salvage will likely be for sale. Both left side wheels have bent barrels from hitting debris in the road in weeks preceding this but I already have new barrels on the way from BC. The left rear has some black scuffs, paint transfer on a spoke or two but nothing that wont wipe off IMO. To be entirely honest I'd prefer they offer high and just take the car, but I'm not in the business of getting fucked and not afraid to be a thorn in an adjusters side if I need to be. This isn't what I wanted and I'm damn sure not going to take a bath because some kid was too busy playing on his phone to drive. Some prorating/depreciation is expected and acceptable but if they don't settle with me on a sufficient number the kid and his family are going to get served with a lawsuit on top of it all. Dismantling is almost complete, check the Member Classifieds for goodies still available.
The offer from insurance was less than I'd hoped for, since it ended up resting soley on my own policy due to woefully inadequate coverage of the other party (who would have thought.....) they would not pay me for any of my mods/upgrades. The basis car valuation was fair though, and I chose to retain the salvage off the top of that payment so I could dismantle an sell off items and bridge some of the gap between what I felt the car was worth upgrades taken into account, and what they were actually able to pay out. There is a lot that I cannot recover however in parts that were destroyed or otherwise not tangible. Teen driver and his parents will be served with a demand letter and a pending small claims suit in attempts to recover those losses. |

WOW! Where do you start on this one? For starters I'm an agent. Kids- they suck! Cell phones - suck! Insurance settlement - sucks even worse!. Good thing is that you're ok except for that burn.
Best outcome - M5...looks sick! Good for you! Blessing in disguise. I will back you on the small claims court deal... I would have done that exact same except biggie size the pain-n-suffering bs. Any attorney should swing for the fence on this but ...everyone is different. I've been doing the Ins gig for 20+ years and still hate insurance companies!! Necessary evil I suppose but it pays for my BMW's so what are you gonna do.... Good luck with this crap. Sucks I know but at least you have your ballz. |
