I also emailed BMWNA and got this response today. I pretty much copied the email another poster on here sent and changed a few words around.

I'll believe the 704 when I see it. Too hard to tell now what is going to happen, and if it does happen that BMW will do anything for the Pre-Sept build people.

The Change Notes is dated 8/15/13.
I assume thats when the change was made to make Msport Susp available.

Just left dealer and placed an order with September build and on the Vehicle Inquiry Report sheet there is a line item - 704 M Sport Suspension.

I had a previous order with a build for August (car is complete and at the port now) and when checking that Vehicle Inquiry Report sheet, there was no line item for 704.

I never want to speculate but I doubt BMW will do anything for those buyers of pre-September builds. Kinda falls under buyer beware because there is no paperwork suggesting that the M suspension is included, nor does it say on the window sticker. I hope I'm wrong.

So did you reject the August car because it did not have 704?

Yes, I rejected the previous order. The dealer and sales rep were both very understanding and accomadating to the change. No resistance at all.

Where does it say effective May 21st? If that's the case, then this was obviously a supplier issue and BMW couldn't backtrack those orders, so supplied them onto would would be pseudo-"lemons" for a month or two until their right batch kicked in. It seems like all too good of timing for them to get on this so quickly after our message boards went afire.

Justin on the other forum initially said that BMW will NOT retrofit non-704 cars with 704, but recently his tune seems to have changed on that (if he even has any idea on that part) to saying that BMW "will make it right" and to entrust them. Jon over there also, seems very confident that BMW will make it right for you and to trust them, so hopefully BMW steps up.

If it was a supplier issue, they should have shut down production of MSports instead of dumping them on us. I get the whole caveat emptor thing, but this is total B.S.

Edit: apparently there's a change log effective 8/15, so although it states a May 21st effective date, that's not the effective date for every item.

Ah, there we go. The change log was due to the inclusion of the M Sport obviously. I really think the forums uprising is what made BMW do right here.

So I see you guys don't get the 704 on the 528i, was that the cause for the 2013 also?

Here in Europe all RWD f10 can get the 704 included in the m-sport package, even the new 518d.

BTW, even the 704 was to weak for me, but the KWv3 helped a lot, but I still like to see less roll in high speed corners.

I think that's because engine size = status here in the states. BMWUSA marketing team thinks that 528 buyers are posers who buy an image. Of course with the 535 and 550 costing more buyers may be looking for more.

that said IMHO if you are spending money on msport packake on any bmw then you are looking for more performance and one of the most important would be suspension.

Ironically the one area the 528i may even outdo its more endowed siblings is in handling due to a lighter front portion, therefore you'd think the M suspension would be perfect for it, in showcasing the F10 in its lightest therefore most handling savvy U.S spec iteration.

I agree. that 528 is better balanced than the 535/550.

I never quite understood what's the difference between passive and adaptive M suspension.

My 13 535XI M sport doesn't have the M suspension.

Unless you drive a 1 or 3-series. Then "Adaptive M-sport suspension" is an option on many models.

We will see for me early next week. I sent my sales rep an email stating that I will accept a retrofit of the M sport suspension or produce a new 550i.

I just went to the BMWusa website and saw it will be included starting on Sept builds (I have a lot going on so I wasn't able to follow this thread recently). I am glad we forum members were able to get this taken care of. Good job guys.
